Terms and Conditions

Welcome to Sonic Haven Studios! These terms and conditions outline the rules and regulations for the use of Sonic Haven Studios' services, located at 320 Barton Creek Rd, Austin, TX 78704. By accessing our studio or using our services, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our studio or services.

1. Definitions

In these terms and conditions:

• "Studio" refers to Sonic Haven Studios, located at 320 Barton Creek Rd, Austin, TX 78704.
• "Client" refers to any individual, group, or entity that uses the Studio's services.
• "Services" refers to all recording, mixing, mastering, production, and related services offered by the Studio.
• "Session" refers to a scheduled period of time for using the Studio's facilities and services.
• "Materials" refers to any audio recordings, data, or other content created, recorded, or stored at the Studio.

2. Booking and Payment

1. All bookings are subject to availability and confirmation by the Studio.
2. A deposit may be required to secure a booking. The deposit amount will be specified at the time of booking.
3. The remaining balance is due upon completion of the Session, unless otherwise agreed in writing.
4. Payment can be made via cash, credit card, or other methods agreed upon by the Studio.
5. Cancellations made less than 48 hours before the Session may be subject to a cancellation fee equivalent to the deposit amount.
6. Sonic Haven Studios reserves the right to modify its rates and fees at any time, but will provide reasonable notice to Clients.

3. Studio Usage

1. Clients are expected to use the Studio's equipment and facilities with care and respect.
2. Any damage to equipment or facilities caused by the Client will be the Client's responsibility, and the Client will be liable for the cost of repair or replacement.
3. Clients must adhere to all safety regulations and guidelines provided by the Studio staff.
4. The Studio reserves the right to terminate a Session if the Client's behavior is deemed disruptive, unsafe, or in violation of these terms and conditions.
5. Clients are responsible for their personal belongings while at the Studio. The Studio is not liable for any loss or damage to personal property.
6. No illegal activities, including but not limited to drug use, are permitted on the Studio premises.

4. Intellectual Property

1. The Client retains ownership of all Materials created during the Session, unless otherwise agreed in writing.
2. The Studio retains ownership of its equipment, software, and any proprietary techniques used during the Session.
3. The Client grants the Studio the right to use excerpts of the Materials for promotional purposes, unless the Client specifically requests otherwise in writing.
4. The Client is responsible for obtaining all necessary licenses and permissions for any copyrighted material used in their recordings.
5. Sonic Haven Studios respects intellectual property rights and will take appropriate action to address any claims of copyright infringement.

5. Liability

Sonic Haven Studios is not liable for any direct, indirect, incidental, or consequential damages arising from the use of its services, including but not limited to:

• Loss of data or recordings
• Equipment malfunction or failure
• Personal injury or property damage
• Delays or interruptions in service

The Client agrees to indemnify and hold Sonic Haven Studios harmless from any claims, damages, or liabilities arising from the Client's use of the Studio's services.

6. Confidentiality

Sonic Haven Studios agrees to keep all Client information and Materials confidential. We will not disclose any Client information to third parties without the Client's consent, unless required by law.

7. Termination

Sonic Haven Studios may terminate these terms and conditions at any time, with or without notice, if the Client violates any of the terms or conditions outlined herein. Upon termination, the Client must cease using the Studio's services and return any Studio property in their possession.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these terms and conditions shall be resolved in the state or federal courts located in Travis County, Texas.

9. Amendments

Sonic Haven Studios reserves the right to amend these terms and conditions at any time. Any changes will be posted on the Studio's website and will be effective immediately upon posting. It is the Client's responsibility to review these terms and conditions periodically to ensure they are aware of any changes.

11. Entire Agreement

These terms and conditions constitute the entire agreement between the Client and Sonic Haven Studios with respect to the use of the Studio's services and supersede all prior or contemporaneous communications and proposals, whether oral or written.

12. Severability

If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
